Legal Services Agreement

1. PARTIES TO THIS AGREEMENT. Lien Lawyers, PLLC, will hereinafter be referred to as the (“Firm”). You, the individual or business purchasing the preparation of Lien Documents on LienLawyers.com, will hereinafter be referred to as the (“Customer”). This Agreement shall govern all services provided by the Firm to Customer.

2. SCOPE OF SERVICES. Customer hereby retains the Firm to prepare, serve, and file Lien Documents incorporating the information provided by Customer immediately prior to reviewing this Agreement and making payment on LienLawyers.com. Lien Documents consist of a Lien Affidavit and statutorily required notice documents, if applicable. If Customer has provided information relating to a public (government-owned) project, Customer authorizes the Firm to prepare Bond Claim Documents in lieu of the Lien Documents. Bond Claim Documents consist of a Sworn Statement of Account and notice letters, if applicable.

The Firm will prepare and provide the Lien Documents to Customer within seven (7) calendar days of receiving payment by Customer. When Customer signs and returns the signed Lien Affidavit as instructed, the Firm will proceed with serving any notice documents and filing the Lien Affidavit in the applicable county records. The Firm does not agree to file the Lien Documents within the time constraints set forth by the Texas Property Code. It is the responsibility of the Customer to timely submit the information to the Firm to ensure timely service and filing of the Lien Documents. You may reference the chart on the final page of this Agreement to determine whether your desired Lien Documents are timely.

The Firm’s obligations are limited only to the preparation of the Lien Documents. The Firm does not represent the Customer in connection with the matter underlying the Lien Documents, or any other matter. The Firm will not file suit on behalf of the Customer to recover the debt underlying the Lien Documents. If the Customer wishes to pursue legal action after the Firm has prepared the Lien Documents, the Firm may refer the Customer to a separate law firm to handle litigation of the Customer’s claim.

Customer represents and agrees that it will provide complete and accurate information to the Firm for the preparation of the Lien Documents. The Firm assumes the information submitted by the Customer is true and accurate and will not vet any of Customer’s information. The Firm will prepare the Lien Documents in reliance on the information provided by the Customer. The Firm may contact the Customer by phone or email if it needs clarification on any of the information submitted by the Customer for completion of the Lien Documents.

3. COST OF LEGAL SERVICES. The Firm charges a flat fee of $699.00 for preparation, service, and filing of the Lien Documents on Customer’s behalf. The Customer will make this payment via the Firm’s online payment portal following its checking of the box marking its assent to the terms and conditions found in this Agreement.

4. DISPUTE RESOLUTION. TO THE EXTENT A DISPUTE ARISES BETWEEN CUSTOMER AND THE FIRM FOR SERVICES PROVIDED UNDER THIS AGREEMENT, THE PARTIES AGREE TO ATTEMPT TO INFORMALLY RESOLVE THE DISPUTE BY MEDIATION AS A PRECONDITION TO BINDING ARBITRATION. IN THE EVENT THE DISPUTE IS NOT RESOLVED THROUGH MEDIATION, THE PARTIES AGREE THAT THE DISPUTE WILL BE RESOLVED BY BINDING ARBITRATION WITH THE AMERICAN ARBITRATION ASSOCIATION LOCATED IN DALLAS, TEXAS. THIS AGREEMENT SHALL BE CONSTRUED UNDER AND IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS. THE PARTIES HERETO WAIVE THEIR RIGHT TO A TRIAL BY JURY. THE CUSTOMER HAS READ, UNDERSTANDS, AND AGREES TO THIS PARAGRAPH.

Residential

The 15th day of the second month after the month you provided labor and materials to the Property for which you were not paid.

The Lien Affidavit must be filed by the 15th day of the third month after the last month you performed work on the Property.

Commercial

The 15th day of the third month after the month you provided labor and materials to the Property for which you were not paid.

The Lien Affidavit must be filed by the 15th day of the fourth month after the last month you performed work on the Property.

Public or Government-Owned

N/A

The Bond Claim must be served by 15th day of the third month after the month you provided labor and materials to the Property for which you were not paid.
